Darkhorse Attorneys is a boutique intellectual property law firm that counsels business clients on how to obtain and protect their trademark rights by a variety of methods. This includes directing our clients to use advertising, marketing, and other branding efforts to maximize their common law rights and to utilize federal trademark law, also known by its popular name, the Lanham Act. Sometimes, we advise business clients to pursue federal trademark protection by applying for a federal trademark registration at the United States Patent at Trademark Office.

Use an Experienced Trademark Law Firm to Register Your Trademark

According to the United States Patent and Trademark Office, a federal trademark registration serves three basic purposes: (1) it identifies you as the source of certain goods and services; (2) it protects from counterfeiting and fraud by giving you the exclusive, nationwide rights to use your name and logo; and (3) it protects your brand so that no one else can profit from your work or reputation, known in the law as your brand’s goodwill.

A federal trademark registration generally gives you exclusive rights throughout the United States to your name, logo, and other unique, defining aspects of your work. It also gives you the right to prevent anyone else in the United States from using a similar name, logo, or style in association with the same goods or services. This will be crucial when other businesses come along and attempt to emulate your branding, which is inevitable in today’s digital business environment. When that happens, having a federal trademark registration will save you the time and expense of having to prove that you are, in fact, the sole owner of your brand. Note that there are some exceptions, and the federal system is complicated, which is why a business should always use an experienced trademark attorney to register its trademarks and otherwise develop a legal strategize to protect its brand.

Just some of the brands we have helped include:

The trademark for Cenvar Roofing and Solar
The trademark for software company Squirrel Fight Interactive
The trademarked logo for Patrick Henry Family Services

Trademark Lawyers: Trademark Maintenance and Trademark Policing

After helping you gain a federal trademark registration, we’re here to help you in the long run. Our Virginia trademark lawyers provide trademark policing and maintenance services so that you can preserve your trademark rights for many years to come. Policing involves periodically checking the USPTO database to see whether there are pending registrations that are similar to your mark(s) and taking appropriate action to prevent them from succeeding. Policing also involves identifying known infringers, informing them that they are violating your trademark rights, and taking appropriate measures to prevent further infringement.

At Darkhorse Attorneys, we also provide trademark maintenance services, which are essential to protecting your brand in the long term. After you obtain a federal trademark, you are required to submit a “maintenance filing” to the USPTO every five years in order to retain your rights to a specific name, logo, or other protectable attribute of your business. We’re here to make sure you never miss a deadline and hold onto your trademark rights for as long as possible.

Trademark Attorney Frequently Asked Questions

You automatically have limited trademark rights in your branding when you begin using it in commerce (assuming that no one else is using a similar mark). However, such rights are limited to your geographic area and do not provide nationwide protection. If you wish to obtain protection that will allow you to stop anyone in the United States from using your mark, you must obtain a federal trademark with the USPTO. Getting a federal trademark registration for your brand is essential if you want to grow your business. Business owners who want to expand, create a franchise, or license the use of their brand are usually required to have a federal trademark registration. If you don’t have a federal registration, you may be disqualified from growth opportunities like these. As an added benefit, obtaining a federal trademark allows you to use “TM” next to your mark, so that consumers and other business owners are aware that your mark is protected. This also adds credibility to your brand and tells the public that you’re the real deal.

Part of all of our trademark services include a trademark search by one of our trademark attorneys. We have searched, applied for, and acquired hundreds of trademarks and are very familiar with the issues that can arise. We use a proprietary search service, called TMTKO, that helps us search both the USPTO trademark database, called TESS, and also uses in other databases like state business databases and other places demonstrating potential common law use. Sometimes, our search discovers that there is a prior user that may prevent the registration of a trademark, or, in some cases, may create potential liability for our client. In those cases, our trademark attorneys help our clients with rebranding.

An experienced trademark attorney like can assess whether the best method of protection for you is registering a federal trademark. Our law firm has experience registering both wordmarks and design marks with the United States Patent and Trademark Office. We also have lawyers experienced with trade dress protection for product colors, product packaging, and product design. Our trademark lawyers will assess whether seeking trademark protection with the United States Patent and Trademark Office is worthwhile, as compared to some other form of protection, like common law trademark protection or state trademark registration.
